1. Purpose and Scope

This Acceptable Use Policy (“AUP”) defines the rules and standards governing the use of the Aflux platform, operated by Atek Software. The purpose of this AUP is to ensure that the Services are used in a lawful, safe, and responsible manner, and to protect Aflux, its users, and third parties from harm, abuse, or misuse.

This AUP applies to all users of the Services, including users of the Free, Pro, Business, and Enterprise plans, and to all components and modules of the Platform, including Bulk Email, Electronic Signature, QR Code Generation, file storage, and core user and access management services.

This AUP forms part of and is incorporated by reference into the Terms of Service. Capitalized terms not defined in this AUP have the meanings given in the Terms of Service.

Violations of this AUP may result in enforcement actions by Aflux, including restriction, suspension, or termination of access to the Services, in accordance with the Terms of Service and applicable law.

2. General Use Requirements

Users must use the Aflux platform responsibly and in compliance with this Acceptable Use Policy, the Terms of Service, and all applicable laws and regulations.

  • Use the Services only for lawful purposes and in a manner that does not facilitate or promote illegal, fraudulent, or harmful activities
  • Comply with all applicable laws and regulations, including those relating to data protection, electronic communications, intellectual property, and consumer protection
  • Respect the rights of others, including privacy rights, intellectual property rights, and contractual or legal rights of third parties
  • Follow instructions, usage limits, and technical restrictions imposed by Aflux, including limitations based on subscription plans, system safeguards, and security measures

Failure to comply with these general requirements may result in enforcement actions as described in this AUP and the Terms of Service.

3. Prohibited Activities (Global)

Users must not use the Services in any manner that is unlawful, harmful, or interferes with the proper operation of the Aflux platform. Without limiting the foregoing, the following activities are strictly prohibited:

  • Engaging in illegal, fraudulent, deceptive, or abusive activities, including activities that mislead, exploit, or cause harm to others
  • Distributing, transmitting, or uploading malware, spyware, viruses, or other harmful code that could compromise the security or functionality of the Platform or third-party systems
  • Attempting to gain unauthorized access to the Services, accounts, systems, networks, or data, or interfering with or disrupting the operation of the Platform
  • Circumventing or attempting to circumvent security measures, usage limits, or access controls, including rate limits, quotas, or plan restrictions
  • Reverse engineering, decompiling, disassembling, or otherwise misusing the Platform, except to the extent expressly permitted by applicable law
  • Misrepresenting identity or authority, including impersonating another person or entity or falsely claiming affiliation, authorization, or endorsement

Aflux reserves the right to take appropriate enforcement action in response to any prohibited activity, as provided in this AUP and the Terms of Service.

4. Content Restrictions

Users must not upload, transmit, send, store, or otherwise process content through the Aflux platform that is unlawful, harmful, or inappropriate. In particular, the following types of content are strictly prohibited:

  • Content that is unlawful, defamatory, obscene, or otherwise illegal, including material that violates applicable criminal or civil laws
  • Content that infringes or misappropriates intellectual property rights, privacy rights, or other proprietary or personal rights of any third party
  • Content containing malicious code, malware, or deceptive material, including phishing content or misleading representations intended to deceive recipients or users
  • Content that encourages or promotes violence, hatred, harassment, or discrimination based on protected characteristics or otherwise
  • Content that violates applicable regulations, including those relating to electronic communications, advertising, consumer protection, or data protection

Users are solely responsible for ensuring that all content processed through the Services complies with this AUP and applicable laws. Aflux reserves the right to remove or restrict access to prohibited content and to take enforcement action as appropriate.

5. Bulk Email–Specific Rules

The Bulk Email module must be used responsibly and in strict compliance with applicable laws and industry standards. In addition to the general prohibitions set out in this AUP, the following rules apply specifically to the use of the Bulk Email module.

5.1 Prohibited Uses (Bulk Email)

Users must not use the Bulk Email module to:

  • Send spam or unsolicited bulk messages, including messages sent without a valid legal basis or recipient consent
  • Use purchased, scraped, rented, or third-party mailing lists, or any lists obtained without the recipients’ explicit and lawful permission
  • Engage in phishing, scams, impersonation, or deceptive practices, including misleading subject lines, sender information, or message content
  • Circumvent, disable, or interfere with unsubscribe or opt-out mechanisms, or continue sending messages to recipients who have opted out
  • Violate applicable anti-spam and electronic communications laws, including the GDPR, the EU ePrivacy Directive, CAN-SPAM Act, or similar regulations

5.2 User Obligations (Bulk Email)

Users of the Bulk Email module are required to:

  • Obtain and maintain lawful consent or another valid legal basis for sending email communications to all recipients
  • Provide accurate and identifiable sender information, including a valid sender name and contact details
  • Include functional and clearly visible opt-out or unsubscribe mechanisms in all bulk email communications and honor opt-out requests promptly

Aflux reserves the right to monitor usage patterns for abuse indicators and to suspend or terminate access to the Bulk Email module where misuse or non-compliance is identified, in accordance with this AUP and the Terms of Service.

6. Electronic Signature–Specific Rules

The Electronic Signature module must be used in a lawful and responsible manner. In addition to the general restrictions set out in this AUP, the following rules apply specifically to the use of the Electronic Signature module.

6.1 Prohibited Uses (Electronic Signature)

Users must not:

  • Impersonate signatories or attempt to sign documents on behalf of another person without proper authorization
  • Forge electronic signatures or misrepresent authority, identity, or intent in connection with any document or signature request
  • Use electronic signature workflows for unlawful, deceptive, or fraudulent purposes, including the execution of documents that violate applicable laws
  • Circumvent, manipulate, or interfere with signing workflows, audit trails, or security mechanisms provided by the Platform

6.2 User Responsibilities and Limitations (Electronic Signature)

Users acknowledge and agree that users are solely responsible for determining the legal validity and appropriateness of using electronic signatures for their specific documents, transactions, and jurisdictions, and that Aflux does not verify the identity, authority, or intent of signatories and does not provide legal advice or guarantees regarding the enforceability of electronically signed documents.

7. QR Code–Specific Rules

The QR Code module must be used responsibly and in compliance with applicable laws and this Acceptable Use Policy. In addition to the general requirements set out above, the following rules apply specifically to the use of the QR Code module.

7.1 User Obligations (QR Code)

Users must:

  • Ensure that all content accessible through QR codes is lawful, accurate, and appropriate, and does not violate applicable laws or third-party rights
  • Manage access permissions and lifecycle settings responsibly, including activation, expiration, and access restrictions for QR-linked content
  • Avoid misleading, malicious, or deceptive use of QR codes, including practices that could confuse, manipulate, or harm individuals who scan the QR codes

7.2 Prohibited Uses (QR Code)

Users must not generate or distribute QR codes that:

  • Lead to harmful, illegal, or deceptive destinations, including content involving fraud, malware, phishing, or other abusive practices
  • Misrepresent the nature or purpose of the linked content or otherwise mislead users regarding what they will access by scanning the QR code

Aflux reserves the right to disable or restrict QR codes and take appropriate enforcement action where misuse or non-compliance with this AUP is identified.

8. Resource Abuse and Fair Use

Users must not engage in activities that unreasonably consume resources or otherwise interfere with the stability, performance, or availability of the Aflux platform.

  • Engage in excessive or abusive usage that degrades or disrupts the Services or negatively impacts other users
  • Perform automated scraping, crawling, or load attacks, including activities intended to extract data or overwhelm system resources
  • Circumvent or attempt to circumvent quotas, usage limits, or plan restrictions, including limits based on subscription tier or technical safeguards

To protect the integrity and performance of the Platform, Aflux reserves the right to enforce rate limits and usage controls and to throttle, restrict, or temporarily limit usage where necessary to prevent abuse, maintain service quality, or ensure fair use for all users.

9. Enforcement and Consequences

Aflux reserves the right to enforce this Acceptable Use Policy and to take appropriate action in response to suspected or actual violations.

  • Investigate suspected violations of this AUP, including reviewing usage patterns, content, or activities where reasonably necessary to assess compliance
  • Suspend, restrict, or terminate access to the Services or specific modules, in whole or in part, in accordance with the Terms of Service
  • Take immediate action without prior notice in serious cases, including where continued use may cause harm, violate the law, or pose security or operational risks
  • Cooperate with legal or regulatory authorities where required by applicable law, regulation, or lawful request

Enforcement actions are taken at Aflux’s discretion and are intended to protect the Platform, its users, and third parties from harm or misuse.

10. Reporting Violations
